  1. Non-Assign ability. Parking privileges may not be transferred, assigned or resold.

  3. Parking Pass. A pass allowing access to and from the parking facilities ("Parking Pass") will be issued upon the applicant's submission of a completed Parking Pass Application. The parking pass may be used only in accordance with these Rules and Regulations, and at all times remains the property of MMC.

  5. Parking Fees. Weekly parking fees are established by the MMC Parking Department and are subject to change. The MMC Parking Department will give parking pass holders as much advance notice of change as is possible. The parking fee will be paid by payroll deduction.

  7. Lost, Stolen or Damaged Monthly Cards. A lost, stolen or damaged parking pass will be replaced promptly upon notification to the MMC Parking Department. In no event will the MMC Parking Department or the Parking facilities be responsible for the value of lost goods or costs incurred, or for the inability of a parking pass holder to use the Parking facilities, due to a lost, stolen, damaged or defective Parking Pass, nor shall parking fees be prorated, refunded, or otherwise reduced by reason thereof.

  9. Use of the Parking Facilities. The MMC Parking Department may establish and distribute operating rules relating to proper use of the parking facilities over and above these terms. A parking pass holder must comply with such operating rules, these Rules and Regulations and other applicable laws and regulations, and shall follow safe driving practices at all times while in the Parking facilities.

  11. No Storage or Abandonment. The Parking facilities may not be used for storage of vehicles or other equipment. Any vehicle or equipment remaining in the Parking facility for more than five (5) calendar days shall be deemed abandoned and may be removed from the Parking facility. The MMC Parking Department will endeavor, but is not required, to send notification to the Parking Pass Holder if vehicle is deemed abandoned. All costs incurred in removing and storing any such abandoned vehicle or equipment shall be reimbursed by the Parking Pass Holder upon being billed by the MMC Parking Department.

  13. Default. If the Parking Pass Holder violates these Rules and Regulations in any other respect and fails to cure such violation within any period reasonably designated by the MMC Parking Department, the MMC Parking Department may immediately suspend all parking privileges and deactivate the Parking Pass.

  15. No Liability of MMC Parking Department or Parking facilities Owner. Payment through payroll deduction applied toward the parking fee grants the parking pass holder a license to park only, and no bailment is intended or shall be deemed created. To the fullest extent permitted by law, neither the MMC Parking Department nor the Parking facility owner, nor their respective officers, directors, beneficiaries, agents, employees, successors and assigns, shall be responsible or liable to any extent for damage to or theft of any vehicle or its contents due to fire, collision, vandalism or any other cause, injuries or liabilities suffered by any person while using the Parking facilities; or any losses or other damages incurred by any party by reason of that party's inability to use the Parking facilities.
